These Terms of Use govern your access to and use of AuctionQR, a browser-based live auction tool that helps event hosts create auction items, display a QR code, receive bids, manage live bidding and export auction results. By accessing or using AuctionQR, you agree to these Terms of Use. If you do not agree, do not use the service.
AuctionQR provides software tools for running live, in-person or online-assisted auctions. The service may allow hosts to create an auction, add auction items, invite bidders by QR code or link, receive bids, mark items as sold or unsold, display live auction information on a screen, and export results.
AuctionQR is a software platform only. AuctionQR is not an auctioneer, broker, escrow agent, payment processor, charity, nonprofit organisation, marketplace, shipping provider, legal adviser, tax adviser or financial adviser.
You may use AuctionQR only if you are legally able to enter into these Terms of Use and comply with all applicable laws. If you use AuctionQR on behalf of a company, charity, school, club, association or other organisation, you confirm that you have authority to bind that organisation to these Terms of Use.
You must not use AuctionQR if you are prohibited from doing so under applicable law or if your use would cause AuctionQR, another user, a host, a bidder or any third party to breach any law or regulation.
If you create or manage an auction, you are the host. Hosts are solely responsible for the auction they run, including:
If you join an auction or place a bid, you are a bidder. Bidders are responsible for reading the auction information and the host's rules before bidding. By placing a bid, you understand that the host may treat your bid as a commitment to buy the item if you are the winning bidder.
Bidders are responsible for the accuracy of any nickname or information they provide, for keeping their bidding device secure, and for not placing bids they are not authorised or prepared to honour.
AuctionQR records bids and displays auction information based on the data available to the service at the time. The host remains responsible for confirming final winners, final prices and settlement. AuctionQR does not guarantee that any bid will result in a completed sale or that any winner will pay.
If there is a dispute about an item, bid, winner, payment, delivery, refund, event rule or auction result, that dispute is between the host and the relevant bidder or third party. AuctionQR may provide available system records to the host when reasonably possible, but AuctionQR is not required to resolve disputes and is not responsible for the host's final decision.
Unless a future feature expressly states otherwise, AuctionQR does not process payments, hold funds, provide escrow, verify payment cards, issue tax receipts, or transfer money between bidders and hosts. Hosts and bidders must arrange payment and fulfilment separately.
You must not use AuctionQR for any illegal, misleading, harmful or abusive purpose. You must not use the service to offer, sell, promote or facilitate items or activities that are unlawful or that require licences, permits or age verification unless you are fully responsible for obtaining and enforcing those requirements.
Examples of prohibited or restricted use include, without limitation: fraudulent listings; counterfeit goods; stolen goods; weapons; illegal drugs; regulated medicines; illegal gambling; unauthorised raffles or lotteries; adult or exploitative content; hate, harassment or abuse; items that infringe intellectual property rights; and attempts to evade sanctions, export controls or other legal restrictions.
You must not interfere with, overload, reverse engineer, scrape, probe, attack, bypass security controls, access another user's auction without permission, or use automated tools in a way that harms the service or other users.
AuctionQR may provide host access through an admin link, token, auction code, recovery code or similar mechanism. You are responsible for keeping those access details secure. Anyone with host access may be able to control the auction, view bidder and result information, mark items sold or unsold, end the auction, export results or otherwise affect the auction.
If you lose access to your host controls, AuctionQR may not be able to restore your auction unless you saved the required recovery information.
You retain ownership of the auction information, item descriptions, photos and other content you submit. You grant AuctionQR a limited licence to host, store, process, display, transmit and use that content as needed to operate, secure, improve and support the service.
You represent that you have the rights and permissions needed to upload and use your content, and that your content does not violate the rights of any third party or any applicable law.
AuctionQR is provided on a best-effort basis. The service may be interrupted, delayed, unavailable, inaccurate or affected by hosting issues, internet connectivity, browser limitations, device problems, third-party services, maintenance, software defects or events beyond our control. Hosts should test their setup before a real event and should have a backup plan for important auctions.
We may change, suspend, limit or discontinue any part of the service at any time. We may also remove or restrict auctions or content that we believe may violate these Terms of Use, create risk, cause harm, breach the law or compromise the service.
The service is provided "as is" and "as available". To the maximum extent permitted by law, AuctionQR disclaims all warranties, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability and error-free operation.
To the maximum extent permitted by law, AuctionQR and its owners, operators, employees, contractors, suppliers and service providers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, goodwill, data, business, opportunity, donations, expected proceeds or auction results.
To the maximum extent permitted by law, AuctionQR's total liability for any claim relating to the service will be limited to the greater of: (a) the amount you paid to AuctionQR for the specific auction or service giving rise to the claim; or (b) USD 100.
You agree to defend, indemnify and hold harmless AuctionQR and its owners, operators, employees, contractors, suppliers and service providers from and against any claims, losses, liabilities, damages, costs and expenses, including reasonable legal fees, arising from or related to your auction, your bids, your content, your breach of these Terms of Use, your violation of law, your dispute with another user, or your misuse of the service.
Our Privacy Policy explains how information may be collected, used, retained and shared when you use the service. By using AuctionQR, you also agree to the Privacy Policy.
We may suspend, restrict or terminate access to the service at any time if we believe your use creates risk, violates these Terms of Use, breaches the law, harms other users, causes technical issues or exposes AuctionQR to liability.

We may update these Terms of Use from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of the service after changes are posted means you accept the updated Terms of Use.
